مرحبًا بك في On Klick!  تحكم هذه الشروط والأحكام ("الشروط") استخدامك لتطبيقنا وخدماتنا المقدمة من قبل مؤسسة حسب الطلب للخدمات التجارية باستخدامك التطبيق أو الوصول إليه، فإنك توافق على الالتزام بهذه الشروط وسياسة الخصوصية الخاصة بنا. إذا كنت لا توافق على هذه الشروط، يُرجى عدم استخدام خدماتنا.

1.            الخدمات

تُقدم On Klick  منصة تتيح لمقدمي الخدمات إدراج خدماتهم، وللعملاء حجز هذه الخدمات. قد تختلف الخدمات المتاحة وفقًا للموقع ومزود الخدمة، ويمكنك الاطلاع عليها عبر التطبيق.

2.             الحسابات

لاستخدام معظم خدماتنا، يجب عليك التسجيل وإنشاء حساب مستخدم شخصي نشط ("الحساب"). يتطلب تسجيل الحساب تقديم معلومات شخصية، مثل الاسم ومعلومات الاتصال والعمر، إلى جانب إدخال وسيلة دفع صالحة (مثل بطاقة ائتمان أو شريك دفع معتمد). أنت مسؤول عن جميع الأنشطة التي تتم من خلال حسابك وتوافق على الحفاظ على دقة وأمان معلومات حسابك.

3.            متطلبات وسلوك المستخدم

الخدمة غير متاحة للأشخاص الذين تقل أعمارهم عن 18 عامًا. لا يجوز لك السماح لأي طرف ثالث باستخدام حسابك، ولا يجوز للأطفال دون 18 عامًا تلقي الخدمات من مقدمي الخدمة إلا بحضورك. كما توافق على الامتثال لجميع القوانين المعمول بها عند استخدام الخدمات، ولا يجوز لك استخدام الخدمات لأي أغراض غير قانونية.

4.            الرسوم والمدفوعات

إذا كنت مزود خدمة، فإنك تدرك أن استخدام الخدمات قد يترتب عليه رسوم تُفرض عليك مقابل الخدمات التي تحصل عليها (يتم تطبيق خصم بنسبة 12% بعد مرور سنة واحدة على تسجيلك). بعد تلقي الخدمات، ستقوم On Klick  بتسهيل عملية الدفع نيابةً عنك، وستكون هذه الرسوم شاملةً للضرائب المطلوبة بموجب القانون.

لا تقوم On Klick  بمعالجة المدفوعات مباشرةً عبر الموقع الإلكتروني. تتم جميع عمليات الدفع بشكل آمن من خلال Moyasar، وهي منصة دفع إلكتروني تابعة لجهة خارجية.

5.            سياسة الاسترداد

يمكنك طلب استرداد الأموال مقابل المنتج الذي تم شراؤه وفقًا لحالات معينة مذكورة في سياسة الاسترداد الخاصة بنا. في حال استيفاء شروط استرداد الأموال، ستقوم On Klick  برد المبلغ إليك مع مطالبتك بتوضيح سبب عدم تلبية المنتج لتوقعاتك.

6.            البريد الإلكتروني

من خلال التسجيل في موقعنا https://on-klick.com، فإنك توافق على تلقي رسائل بريد إلكتروني منا، سواء كانت معاملاتية أو ترويجية (في بعض الأحيان).

7.            المحتوى

قد تتمكن من إرسال محتوى عبر تطبيقنا، مثل التعليقات أو التقييمات. تحتفظ بحقوق الملكية الفكرية لأي محتوى تقدمه. ومع ذلك، من خلال تقديم المحتوى إلى On Klick، فإنك تمنحنا ترخيصًا عالميًا دائمًا لا رجعة فيه ومجانيًا لاستخدامه ونسخه وتعديله وإنشاء أعمال مشتقة منه وتوزيعه.

8.             إخلاء المسؤولية؛ تحديد المسؤولية

لا نضمن جودة أو ملاءمة أو أمان أو كفاءة مقدمي الخدمات التابعين للجهات الخارجية. أنت توافق على أن جميع المخاطر المرتبطة باستخدامك للخدمات تقع عليك وحدك. لا تتحمل مؤسسة حسب الطلب للخدمات التجارية أي مسؤولية عن أي أضرار غير مباشرة أو عرضية أو خاصة أو تأديبية أو تبعية، بما في ذلك فقدان الأرباح، فقدان البيانات، الإصابة الشخصية، أو تلف الممتلكات الناتج عن استخدامك للخدمات.

9.            القانون الحاكم

تخضع هذه الشروط وتُفسر وفقًا لقوانين المملكة العربية السعودية دون أي تأثير على تعارض القوانين.

10.          التعديلات على الشروط

قد نقوم بتعديل هذه الشروط من وقت لآخر. تصبح التعديلات سارية المفعول فور نشرها من قبل مؤسسة حسب الطلب للخدمات التجارية على هذا الموقع أو داخل الخدمات المحدثة. استمرار استخدامك للخدمات بعد نشر التعديلات يُعتبر موافقة منك على الالتزام بالشروط المعدلة.

Terms and Conditions for On Klick

Welcome to On Klick! These Terms and Conditions ("Terms") govern your use of our mobile application and services provided by Establishment HASSB TALAB For Commercial Services. By accessing or using our application, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

1. Services

On Klick provides a platform where service providers can list their services, and customers can book these services. The specific services available can be found within our application and may vary by location and provider.

2. User Accounts

To use most aspects of our services, you must register for and maintain an active personal user services account ("Account"). Account registration requires you to submit certain personal information, such as your name, contact information, and age, along with at least one valid payment method (either a credit card or accepted payment partner). You are responsible for all activity that occurs under your Account and agree to maintain the accuracy, completeness, and security of your Account information.

3. User Requirements and Conduct

The service is not available for use by persons under the age of 18. You may not authorize third parties to use your Account, and you may not allow persons under the age of 18 to receive services from service providers unless they are accompanied by you. You agree to comply with all applicable laws when using the services, and you may only use the services for lawful purposes.

4. Payments and Fees

You (as service provider) understand that use of the services may result in charges to you for the services you receive (an 12% reduction will apply one year after your registration). After you have received services obtained through your use of the service, On Klick will facilitate your payment of the applicable Charges. Charges will be inclusive of applicable taxes where required by law.

On Klick does not process any order payments through the website. All payments are processed securely through Moyasar, a third party online payment provider.

5. Refunds

You can ask for refund against the item purchased under certain circumstances listed in our Refund Policy. In the event that you meet the applicable mark for receiving refund, On Klick will issue you a refund and ask you to specify how the product turned down your item performance expectations.

6. Email

By signing up on our website https://on-klick.com/ you agree to receive emails from us – Transactional as well as promotional (occasional).

7. Content

You may be able to submit content through our app, such as reviews or comments. You retain ownership of any intellectual property rights that you hold in that content. However, by submitting content to On Klick, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, create derivative works from, and distribute such content.

8. Disclaimers; Limitation of Liability

We do not guarantee the quality, suitability, safety, or ability of third-party providers. You agree that the entire risk arising out of your use of the services, and any service requested in connection therewith, remains solely with you. On-Demand Commercial Services Corporation shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, personal injury, or property damage related to, in connection with, or otherwise resulting from any use of the services.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Saudi Arabia without giving effect to any conflict of law principles.

10. Changes to Terms

We may amend these Terms from time to time. Amendments will be effective upon On-Demand Commercial Services Corporation's posting of such updated Terms at this location or in the amended policies or supplemental terms on the applicable service. Your continued access or use of the services after such posting constitutes your consent to be bound by the Terms, as amended.
